General Terms of Service

GENERAL TERMS OF SERVICE (GTS)
Projet 520 (SASU)

Preamble

The company Projet 520, a simplified joint-stock company with a single shareholder (SASU), provides enhanced digital usage protection services, marketed in particular under the offers “Web Shield”, “Web Shield XL”, “Soul Guardian”, “Soul Guardian Family”, and “Soul Guardian XL”.

These General Terms of Service (GTS) define the terms applicable to any subscription.


Article 1 – Purpose of the Service

The purpose of the service is to protect individuals from certain risky digital usages (inappropriate content, addictions, unwanted usage) through the implementation of technical filtering and control measures adapted to the subscribed offer.

Depending on the chosen offer, these measures may rely on:

Either centralized and full device management, implying strict and non-circumventable supervision of digital usage (Soul Guardian, Soul Guardian Family, and Soul Guardian XL offers);

Or the installation of a software filtering component, which may be uninstalled by the User and provides enhanced protection but not equivalent to full device management (Web Shield and Web Shield XL offers).

The User expressly acknowledges that the level of protection, restriction, and non-circumvention varies depending on the subscribed offer.

The service is intended for:
- adults wishing to voluntarily benefit from reinforced supervision of their digital usage;
- parents or legal guardians wishing to protect a minor under their authority.


Article 2 – Technical Requirements and Device Restoration

The User is expressly informed and accepts that, prior to any subscription to the “Soul Guardian”, “Soul Guardian Family”, and “Soul Guardian XL” offers, any previously used mobile device must undergo a complete factory reset.

This reset results in the permanent deletion of all data on the device, including but not limited to: photos, videos, contacts, messages, applications, files, and personal settings.

This operation is essential for the implementation of full device management.

The User acknowledges being solely responsible for:

The prior backup of all personal data, regardless of the storage medium (cloud, computer, external storage, etc.);

The consequences resulting from the absence or insufficiency of backups.

At the User’s request, Projet 520 may provide general advice regarding backup methods, without such assistance constituting an obligation of result or the undertaking of the backup itself.

Projet 520 shall not be held responsible for any data loss related to the device restoration.

When the User purchases a device from Projet 520, the device may, at the User’s request or as part of the subscribed offer, undergo prior technical pre-configuration before delivery or shipment.

This pre-configuration constitutes a service separate from the sale of the hardware and is intended solely for the technical preparation of the device for the execution of the subscribed service.

The User remains, in all cases, the full and exclusive owner of the device, including during the pre-configuration phase, Projet 520 acting solely as a technical service provider.

Unless expressly instructed otherwise by the User, pre-configuration is performed on a device containing no personal data, the User remaining responsible for any data present at the time of delivery of the device.


Article 3 – Temporary Provision of the Device

This article applies exclusively to offers based on full device management, namely the “Soul Guardian”, “Soul Guardian Family”, and “Soul Guardian XL” offers.

Within the framework of these offers, the User remains the full and exclusive owner of the device concerned.

For the sole purposes of executing the service, the User grants Projet 520 a limited technical management mandate concerning only the administration of the operating system and device functionalities.

This mandate implies, for the duration of the contract, a functional and temporary provision of the device strictly limited to the execution of the services provided in these GTS.

During this period:

The administration of the operating system and device functionalities is carried out exclusively by Projet 520;

The User expressly waives any administrative, modification, or circumvention privileges;

This technical management mandate and functional provision constitute an essential and inseparable condition of the service.

The User acknowledges that revocation of this mandate or termination of this provision necessarily results in the termination of the service.

This management mandate is strictly technical and does not grant any legal representation authority or the ability to perform legal acts on behalf of the User.


Article 4 – Fully Managed Device

This article applies exclusively to offers based on full device management, namely the “Soul Guardian”, “Soul Guardian Family”, and “Soul Guardian XL” offers.

The User acknowledges and accepts that within the framework of these offers, the device will be configured in fully managed mode in accordance with professional standards for iOS and Android mobile device management.

This management may include, but is not limited to:

Installation, removal, or restriction of applications;

Blocking of system functionalities;

Application of filtering, security, and usage control rules;

Application of non-removable management profiles;

Locking, erasing, or resetting the device if necessary, particularly in case of loss, theft, or termination of the contract.

These measures constitute the core of the service and are essential to achieving the intended protection objective.

They cannot be circumvented by the User, who acknowledges that any attempt to circumvent them may result in immediate termination of the service.


Management Identification Notice on the Device

Within the framework of offers based on full device management, the User is informed that certain technical notices imposed by the operating system or management platform may appear on the lock screen or in the device settings indicating that the device is managed by Projet 520.

These notices, although they may indicate that the device “belongs” to Projet 520, serve exclusively a technical and informational purpose related to centralized device management and do not constitute any indication of legal ownership.

The User remains, in all cases, the full and exclusive owner of the device, Projet 520 acting solely as a technical service provider within the framework of a temporary management mandate strictly limited to the duration of the contract and to the execution of the service.

Upon termination of the contract, this mandate ends and any indication related to centralized management is removed in accordance with these General Terms of Service.


Article 5 – Minors

This article applies when the service is implemented for the benefit of a minor within the offers based on full device management (“Soul Guardian”, “Soul Guardian Family”, and “Soul Guardian XL”).

In such cases:

The contract is concluded exclusively with the holder of parental authority or the legal guardian of the minor;

The legal guardian expressly requests, with full knowledge, the implementation of centralized and full management of the minor’s device;

The legal guardian declares that they act in the best interest of the minor and under their sole responsibility.

Projet 520 acts solely as a technical service provider, on the instructions of the legal guardian, and cannot be considered an educational, pedagogical, or monitoring authority.

The legal guardian remains solely responsible for:

The framework of the minor’s device usage;

The configuration choices requested;

Supervision and guidance of the minor’s digital usage.


Article 6 – Personal Data and Backup Responsibility

Projet 520 does not access the User’s private personal content, including but not limited to messages, photos, videos, files, or personal communications, except where required by law or strictly necessary for the execution of the service.

Responsibility for backing up personal data remains exclusively with the User.


Article 7 – Technical Account and Service Continuity

This article applies exclusively to offers based on full device management (“Soul Guardian”, “Soul Guardian Family”, and “Soul Guardian XL”).

As part of the service execution, Projet 520 provides the User with a personal technical account strictly limited to the registration and management of the devices concerned.

This technical account does not grant the User any administrative rights regarding infrastructure, management tools, security profiles, or underlying systems operated by Projet 520.

The User is expressly informed that any action, whether voluntary or not, including:

Deletion of the technical account,

Deactivation of the technical account,

Removal of the account from Projet 520’s management environment (including the option “Leave organization” or any equivalent action),

results in the immediate interruption of the service without liability for Projet 520.

Service restoration may require:

Re-creation of the technical account;

Full re-enrollment of the devices concerned;

Additional technical intervention, which may be subject to specific billing communicated beforehand to the User.

The User expressly acknowledges that service continuity is inseparable from maintaining the technical account and its association with Projet 520’s management environment.

The User is also expressly informed that:

Any removal from full device management automatically triggers a factory reset of the device;

It is the User’s responsibility, prior to any termination request or exit from the service, to perform a complete backup of all personal data.

Projet 520 shall not be held responsible for any data loss resulting from the end of the contract, restoration of device control, or any action affecting the technical account.


Article 8 – Loss, Theft, and Damage of the Device

The physical custody of the device is the sole responsibility of the User or, where applicable, the legal guardian.

Projet 520 cannot be held responsible for loss, theft, damage, hardware unavailability, or any damage affecting the device regardless of the cause.

In the event of loss or theft, the User agrees to inform the company as soon as possible in order to enable appropriate security measures such as locking, access restriction, or remote wiping of the device according to the subscribed offer.

The User acknowledges that such measures may result in permanent data loss without liability for Projet 520.


Article 9 – End of Contract and Return of Control

This article applies exclusively to offers based on full device management (“Soul Guardian”, “Soul Guardian Family”, and “Soul Guardian XL”).

Upon termination of the contract for any reason (termination, expiration, non-payment, service interruption, or any other cause), the following consequences occur:

Removal of centralized device management;

Factory reset of the device;

Return of device control to the User.

The User acknowledges that these operations are automatic and inseparable from the end of the service and may result in permanent deletion of all data stored on the device.

The User must perform a complete backup of personal data before requesting termination or before the end of the contract.

The User acknowledges that service continuity is inseparable from maintaining full device management.


Article 10 – Informed Acceptance

The User acknowledges having read, prior to any subscription, the nature, terms, and constraints of the service provided by Projet 520.

In particular, the User acknowledges:

Having been fully informed of the intentionally strict and restrictive nature of the service and, for offers based on full device management, its non-circumventable character;

Understanding that full device management constitutes the core of the “Soul Guardian”, “Soul Guardian Family”, and “Soul Guardian XL” offers;

Having been informed that the “Web Shield” offer relies on software filtering providing a different level of protection and not benefiting from the same level of non-circumvention;

Accepting all technical, practical, and functional consequences associated with the subscribed offer.

The User acknowledges that their consent is given freely, knowingly, and without reservation.


Article 11 – Support

Service support is provided by Projet 520:

By email at: support@projet520.com;

By phone, call, SMS, or instant messaging (WhatsApp) at: +33 6 29 17 39 28.

Support is intended for technical assistance related to the operation of the service, including handling requests for unblocking, adjustments, or incident management.

Projet 520 reserves the right to modify support methods, including the possible future implementation of a dedicated platform, without affecting the User’s rights.


Article 12 – Applicable Law

These General Terms of Service are governed by French law.

In the event of a dispute relating to their interpretation, execution, or validity, and failing amicable resolution, jurisdiction is expressly assigned to the French courts.
